These Terms of Use ("Terms") govern the access to and use of the Hotel Restaurante platform (https://www.hotelrestaurante.com.br) by users, tourists, visitors and guests ("User", "you"). The platform is operated by Sobieski Produções e Desenvolvimento em TI Ltda., registered under CNPJ no. 43.810.141/0001-82 ("Hotel Restaurante", "we" or "platform"). By creating an account, accessing or using any feature of the platform, you declare that you have read, understood and fully accept these Terms. If you do not agree, do not use the platform.
1. Acceptance and definitions
These Terms constitute a binding agreement between you and Hotel Restaurante. Merely browsing, registering or using any feature implies full and unreserved acceptance of the conditions set out herein, as well as of the Privacy Policy, which forms an integral part of these Terms for all purposes.
For the purposes of these Terms, the following definitions apply:
- Platform: the website, applications and digital services of Hotel Restaurante, which operate as a marketplace of tourism classified listings.
- User: the natural person who registers on or uses the platform as a tourist, visitor or guest.
- Establishment: the advertiser (hotel, guesthouse, restaurant, bar, park, event organiser, attraction or similar) that maintains a profile and offers services on the platform.
- User Content: any information, photo, text, review, comment, story or message published by you.
- Booking/Scheduling: the request for or contracting of services directly with the Establishment, technologically intermediated by the platform.
2. Registration and account
To use certain features, you must create an account by providing true, accurate, current and complete information. You are solely responsible for the accuracy of the data provided and undertake to keep it up to date.
Registration is intended for persons with full legal capacity. Persons under the age of 18 may only use the platform with the assistance or representation of their legal guardians, who shall assume full responsibility for the acts performed.
2.1 Responsibility for the password
You are solely responsible for the safekeeping, confidentiality and use of your access credentials (login and password). Any activity carried out through your account is presumed to have been performed by you. In the event of unauthorised use, loss or suspected security breach, you undertake to notify Hotel Restaurante immediately by e-mail at
3. Permitted use and rules of conduct
The platform must be used in a lawful and ethical manner and in accordance with these Terms and applicable law. When using the social and interactive features, you agree to behave in a respectful and responsible manner.
3.1 Social match, friends, chat and stories
The platform offers social features, including a match system (affinity-based connection suggestions), a friends list, chat between users and the publication of stories. These features are intended for legitimate social interaction between travellers. It is prohibited to use them for harassment, hate speech, sexually explicit content, exploitation of minors, scams, the unauthorised disclosure of third-party data or any unlawful purpose.
3.2 Reviews and comments
You may publish reviews and comments about Establishments based on genuine experiences. Reviews must be truthful, made in good faith and free from defamation, slander or insult. The publication of false reviews, reviews improperly paid for, mass reviews or reviews intended to manipulate the reputation of any Establishment or competitor is prohibited.
4. Role of the platform (intermediary)
Hotel Restaurante is an intermediary platform for tourism classified listings. Its function is to connect Users to Establishments, providing tools for searching, displaying profiles, communication, scheduling and payment. The platform is not a party to the relationships, contracts, bookings or transactions entered into between User and Establishment.
Hotel Restaurante does not sell its own rooms, meals, products or services, does not provide accommodation, catering, transport, leisure or tourism services, and does not own, control or operate the advertised Establishments. The profile information (photos, menus, rooms, products, prices, availability and conditions) is provided by and is the sole responsibility of the respective Establishments.
Consequently, the platform is not liable for the quality, safety, legality, accuracy, availability, performance or fulfilment of the services provided by the Establishments, nor for any damage, loss, cancellation, delay or breach of contract arising from that direct relationship.
5. Bookings and direct relationship with the establishment
When making a booking or scheduling through the platform, you enter into a contract directly with the Establishment. The booking conditions, cancellation policy, refunds, prices, fees, schedules, accommodation or consumption rules and other terms are defined and managed exclusively by the Establishment.
Payments are processed through MercadoPago, a third-party payment gateway, subject to that provider's own terms and policies. Hotel Restaurante merely enables the transaction technically and does not hold, custody or administer the amounts relating to the services contracted with the Establishments.
Any complaints, refund requests, disputes over services, charges or cancellations must be dealt with directly with the responsible Establishment. The platform may, at its sole discretion and without any obligation, offer mediation or support channels, without this implying any assumption of responsibility for the consumer relationship.
6. User-generated content and licence
You are solely responsible for the User Content you publish, including photos, texts, reviews, comments, stories and messages. You represent and warrant that you hold all the necessary rights over such content and that it does not infringe third-party rights, legal provisions or these Terms.
By publishing User Content, you grant Hotel Restaurante a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use, reproduce, store, adapt, display, publish, distribute and disclose such content, within the scope of the operation, promotion and functioning of the platform and its associated channels. This licence remains in force for as long as the content stays published and for a reasonable period after its removal, for the purposes of backup, record-keeping and compliance with legal obligations.
Hotel Restaurante does not claim ownership of your content, which remains yours. However, it reserves the right to remove, hide or refuse any content that infringes these Terms, the law or third-party rights.
7. Prohibited conduct and moderation
The User is expressly prohibited, by way of example and without limitation, from:
- Publishing unlawful, defamatory, offensive, discriminatory, violent, fraudulent or obscene content, or content that infringes third-party rights;
- Engaging in harassment, threats, stalking or abuse against other Users or Establishments;
- Using the platform for spam, unauthorised advertising, improper data collection or solicitation;
- Creating fake accounts, multiple accounts for fraudulent purposes or impersonating third parties;
- Using bots, scrapers, crawlers or other unauthorised automated means to collect data or interfere with the operation of the platform;
- Attempting to circumvent security mechanisms, carry out reverse engineering or exploit vulnerabilities;
- Publishing false reviews or manipulating the reputation of Establishments.
Hotel Restaurante may moderate, review, edit, hide or remove content and adopt appropriate measures, at its sole discretion, whenever it identifies a breach of these Terms, acting either upon a report or on its own initiative.
8. Intellectual property
All intellectual property rights relating to the platform — including the trade mark, name, logo, layout, source code, design, databases, texts, features and other elements — belong to Sobieski Produções e Desenvolvimento em TI Ltda. or to its licensors, and are protected by applicable law.
It is prohibited to copy, reproduce, distribute, modify, create derivative works of, commercially exploit or use any element of the platform without prior and express authorisation. Use of the platform does not transfer any intellectual property right to the User, except for the limited licence to use the available features for personal and non-commercial purposes.
9. Account suspension and termination
You may terminate your account at any time using the tools available on the platform or by requesting cancellation via the contact e-mail.
Hotel Restaurante may, at its sole discretion and without prior notice, suspend, restrict or terminate the access of any User who breaches these Terms, engages in prohibited conduct, infringes the law or poses a risk to the platform, to other Users or to Establishments. Termination does not release the User from responsibilities assumed before the termination. Data may be retained for the legally required period, as set out in the Privacy Policy.
10. Limitation of liability
To the fullest extent permitted by law, Hotel Restaurante is not liable for:
- The acts, omissions, services, products, quality, safety or conduct of the Establishments and of other Users;
- Direct or indirect damage arising from bookings, transactions, scheduling or relationships established between User and Establishment;
- Content generated by third parties, reviews, messages or profile information;
- Temporary unavailability, technical failures, interruptions, errors, viruses or force majeure events beyond its reasonable control;
- Social interactions, meetings or connections arising from the match, chat or friends features, it being the User's responsibility to act with prudence and safety.
The platform is provided "as is", without warranties of fitness for a particular purpose. Nothing in these Terms excludes liabilities that cannot be limited by law, in particular under applicable consumer protection rules.
11. Data protection
The processing of personal data complies with Law no. 13,709/2018 (LGPD) and is described in detail in the platform's Privacy Policy, which forms an integral part of these Terms. 12. Amendments
Hotel Restaurante may amend these Terms at any time, with a view to improvements, legal adjustments or changes to the services. Updated versions will be published on this page, indicating the date of the last update. Continued use of the platform after the publication of the amendments constitutes acceptance of the new conditions. We recommend reviewing this document periodically.
13. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. The courts of the Judicial District of São Paulo/SP are hereby elected to settle any disputes arising from these Terms, with waiver of any other, however privileged, save for the consumer's right to bring proceedings in the courts of their own domicile, where applicable.
